Аннотация на русском языке: Роль адвоката в уголовном процессе занимает особое место, так как он является ключевым субъектом, обеспечивающим защиту прав и законных интересов обвиняемого, подозреваемого, а также иных участников процесса. Доказывание, как основополагающий компонент уголовного судопроизводства, предполагает активное участие защитника в сборе, представлении, проверке и оценке доказательств. В статье рассмотрены правовой статус адвоката как участника процесса доказывания, его функции на различных этапах уголовного производства, механизмы, которыми он пользуется для формирования доказательственной базы. Также анализируется влияние участия адвоката в доказывании на общий ход следственных и судебных действий, а также на обеспечение справедливости судебного разбирательства. Помимо этого, исследуются существующие проблемы, препятствующие полному осуществлению адвокатских функций, и предлагаются возможные пути их решения.

The summary in English: The role of a lawyer in criminal proceedings occupies a special place, as he is a key actor ensuring the protection of the rights and legitimate interests of the accused, the suspect, as well as other participants in the process. Proving, as a fundamental component of criminal proceedings, involves the active participation of the defense attorney in the collection, presentation, verification and evaluation of evidence. The article examines the legal status of a lawyer as a participant in the evidentiary process, his functions at various stages of criminal proceedings, and the mechanisms he uses to form an evidentiary base. It also analyzes the impact of the lawyer's participation in evidence on the overall course of investigative and judicial actions, as well as on ensuring the fairness of the trial. In addition, the existing problems that hinder the full implementation of advocacy functions are being investigated and possible solutions are proposed.
